European restriction of DecaBDE Inquiry (采购产品): European restriction of DecaBDE - Supply Assurance Letter to Suppliers from Director of Global Procurement Subject: European Union Restriction of Hazardous Substances (RoHS) and the rescinding of the Deca BDE exemption – Vendor letter #4 Dear Valued Supplier: On April 1, 2008 the European Court of Justice, the judicial body which can rule on the legal interpretation of European law, found that the current exemption granted for Deca BDE (a Brominated flame retardant for plastics) was wrongly awarded by the European Commission in 2005 on the basis of defects in the legal process followed by the EU Commission. The EU Court of Justice has therefore decided that the exemption for Deca BDE will end as of June 30, 2008, effectively banning the use of Deca BDE in products sold into the EU after this date. Therefore companies selling product into the EU need to ensure Deca BDE is not present in their electronic products within homogeneous regions of the components in quantities greater than 1000 ppm. Benchmark Electronics is committed to protecting the environment and complying with the European Directive (EU) 2002/95/EC regarding the Restriction of Hazardous Substances (RoHS). To ensure that Benchmark Electronics and our customers can confidently continue to comply with all RoHS 2002/95/EC requirements, we are requesting our suppliers to formally declare their use or non-use of Deca BDE in the articles that they provide and if they had claimed the exemption described. This requires immediate attention as the EU Court has given a condensed time frame for suppliers to confirm conformance. Please respond by June 20th, 2008 with either, a new, official certificate of RoHS compliance, or written statement clarifying your use, or non-use of the Deca BDE exemption referenced in European Commission Decision of 13 October 2005 (2005/717/EC).
