Enisgn Petroleum Inquiry (采购产品): Enisgn Petroleum Dear Sir/Madam: As you may be aware, Ensign has stopped paying creditors. It is currently in the proceess of liquidating its assets. My client, Highland Tank, believes that this process should be done in the open. Highland Tank seeks to have this process done through the bankruptcy court by filing an involuntary bankruptcy petition. In case you are unfamiliar with this procedure, let me elaborate upon it. In a situation where a debtor is not paying creditors, a creditor can force the creditor into bankruptcy court. The main reason behind this is that, outside of bankruptcy, the creditor has no idea what the debtor is doing with its money and there is no regulation or oversight as to which creditor gets paid, how much each creditor gets paid, how much assets are sold for. Examples of this include paying certain creditors one hundred cents on the dollar while others get little and selling assets at a significant discount. By forcing the debtor into bankruptcy court, the debtor is not permitted to control these types of activities. In order to force Ensign into bankruptcy, three creditors are required to petition the court. We are asking your company to join with Highland Tank. Your company should expect and require the fair and proportional distribution of assets from its debtors when it fails to make payments and dishonors its obligations to you. Highland tanks has agreed to pay for the filing of the petition, and therefore all that is requested of Fred Burack, Co. is to allow us to use your name as another creditor seeking this remedy. We currently have two creditors willing to go forward and solely need a third. By agreeing to join us, you wil be ensuring that the liquidation is fair and transparent, without any behind the scene deals taking place.
