Alternate bids will be considered on products, which meet or exceed products indicated on quote. Vendor is to mark clearly alternate proposals. “OR EQUAL”: Any brand name listed in the specifications as “or equal” or “or equivalent” shall establish the minimum requirements for quality, utility, durability, function, purpose, etc. Other product brands may be offered that are equal to or better than the product brand name. Bidder may show cost differences, alternates and options in the space provided in the quote. This clause is not meant to be restrictive, but to set the minimum standard. AGENCY SHALL DETERMINE, IN ITS SOLE DISCRETION, WHETHER A PRODUCT OFFERED IS “EQUAL.” When the designation is “or equal” or “equivalent” Agency shall make its decision after Bid Closing. All Quotes shall be valid for 30 days from the RFQ closing date. Vendor shall submit photos and specifications of products quoted. These will not be returned. Agency shall not be responsible for any failure attributed to the transmission, or receipt of facsimiled or emailed Quotes. Vendor should confirm Agency receipt. Products shall be delivered FOB Destination to Oregon State Fair at 2330 17th Street NE, Salem, OR 97301 no later than June 15, 2007. Protests will not be entertained. Purchase price shall be all inclusive including, but not limited to, shipping and handling. Agency reserves the right to accept any quote or any part or parts therefore, or to reject any or all quotes. Submission of a quote does not constitute an agreement between Agency and Vendor, nor does it secure or imply that Vendor will be selected.
